These Terms of Service ("Terms") govern your use of the ReShape Method mobile application and related services (the "Service") operated by Fittek Ltd ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.
You must be at least 16 years old to use the Service. By using the Service, you represent that you are at least 16 years of age. The Service is available only to registered members of ReShape Club whose accounts have been created and approved by their coach.
Your account is created by your coach during onboarding. You are responsible for:

The Service is a coaching support tool. It does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any exercise or nutrition programme.
Access to the Service requires an active membership. Membership terms, pricing, and billing cycles are agreed upon during onboarding with your coach.
We may adjust membership fees from time to time. We will give you at least 14 days' written notice before any price change takes effect. Any increase applies from the start of your next billing cycle after the notice period. If you do not wish to continue at the new rate, you may cancel your membership before the change takes effect and no further charges will apply.

The Service is not a substitute for professional medical advice. The nutrition plans, exercise programmes, and coaching guidance provided through the Service are for general fitness and wellness purposes only.
The Service and its content — including but not limited to the app design, training programmes, nutrition plans, algorithms, text, graphics, and logos — are owned by Fittek Ltd and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.
You retain ownership of content you submit through the Service (messages, photos, feedback). By submitting content, you grant us a limited licence to use it for providing and improving the Service. We may retain anonymised, aggregated data derived from your use for analytical purposes.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
To the maximum extent permitted by law:
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
You agree to indemnify and hold harmless Fittek Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where practicable. Continued use of the Service after changes constitutes acceptance of the modified Terms.
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination:
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
